Question going on for stimulous check?
My EX husband is filing to get the stimulus check. He is claiming our two daughters who own not lived with him for 6 years. We are divorced. My girls and I are on social services. He says "Let the organization take care of you" My girls considered necessary to go to college, he refused to wages, so we got financial aide.We are on food stamps. I'am the head of this household and we entail the money. Our income is $800.00 a month. We can't make it. He is forging my name to return with this stimulus money.I need the money to clothe his daughters. He had a huge settlement ending year from a work related injury. His daughters are ingored. He makes life as unyielding as he can on us. Any ideas? Is it legal to forge my cross? We ARE divorced. *THANKS*
Answers: No, of course it isn't legal to forge your term.
If your daughters are in college, they are most likely over 16 and he wouldn't win any stimulus money for them anyway.
If you are saying that he's claiming them on his tax return as dependents, he is not permitted to do that. If your $800 income is NOT all from social services so you have something reportable on a toll return, file a return showing them as dependents and the IRS will climb all over him when both of you claim like peas in a pod kids. If you have NO reportable income, you'd have to report him to the IRS to draw from any action, and then it might or might not surface.
How do you know he's forging your name?
If the kids are living with you, he should not know how to claim them! try tattling on him on the irs website. Karma will catch up to him eventually, but I know thats not enough. He will hold to live with the fact that his kids may call a halt up hating him. doesnt he have to recompense child support? go to court and let thenm know whats going on, and hell probably hold to pay the legal fees motive he is at fault! good luck! Report him .If you hold proof the kids have been beside you then
he cant claim them.
pretty much whoever files the girls first gets the dependency money - the other have to refile. no it is against the law and called fraud if he is signing your describe to a check. Contact the authorities.
Sorry....you need to go hindmost to court... OK...1st of all, how old are your daughters...you read aloud they wanted to go to college...that imply to me they are older. You must remember that anyone over the age of 16 does not qualify for the rebate for dependency.
2nd...he cannot go against your divorce rule. Have you filed your taxes yet? Did you claim your girls? Then you seize the rebate. There is no filing just to go and get the stimulus...you file your 2007 return and that is what determines the rebate. If you've already file then it doesn't matter if he is file now, your return has be processed and you get the money.
If you haven't filed nonetheless then you need to report and claim them...the government will stop both returns and review them because the girls SSN's would be on both returns...then you would newly have to prove he did not have a right to claim them. If you can prove that after you do not have a problem. If he is forging your name to be precise pretty easy to prove as well. Of course it is iffy for him to forge your name and tell him if he does it you will contact the authorities for identy thieving and forgery...that might be all he needs to stop him.
If it be me and I haven't filed yet I would do that ASAP (if not for the single fact you cannot qualify for any rebate unless you file your levy return). Remember that if he has just file he won't get the rebate according to the IRS published schedule...that diary is only for people who file and their returns were processed by April 15th...now he will own to wait til the end of the summer at the earliest to even seize his rebate processed...that gives you plenty of time to stop him.
