Not self salaried overtime after 40hours.?
Here is the situation. My mom earn 10.56 an hour. She worked 40 hours at regular rate and 32 hours overtime. Total of 72 hours. Her employer calculated her overtime as 10.72x32. Instead of calculating 1.5 times her regular rate...they calculated 1.5 times minimum wage (7.15 here in NYS). Can they do that? Arent they supposed to calculate 10.56x1.5 as overtime?
