My ex is claiming my son on his income tariff and I want to catch him!?

What can I do and what are the charges for fraud with this.


Answers:    If the child lives beside you and your ex doesn't have a valid court direct that he can claim your son, then you are the one who can claim him. If he already file, you'll have to record by mail, you won't be capable of efile. But go ahead and claim him. Your ex and you will respectively receive a letter from the IRS relating you that two people claimed duplicate person, and dictum that whoever didn't have the right to the claim wants to file an amended return dropping the claim - afterwards if nobody does, they'll investigate and decide who get the exemption. The other person will hold to pay subsidise whatever he get by making the claim he wasn't entitled to, with interest and possible penalty. There aren't fraud charges involved in something similar to this.

Let go of the "draw from him" attitude though - you'll live longer and happier.
If your ex already filed his w2 near the gov, i doubt you'll be able to do something but manifestly try calling 18OO-829-1040 and explain the situation with IRS and they will any direct you to an advocate (they are free of charge) or I don`t know to the correct department. Good luck
