for 2 days and then moved here. The W4 be not updated (we are new to the country and didnt know that we have to). We went to H&R block and they said, he'd enjoy to pay both state taxes and since the W2 have the NJ address, we might not be refunded. He is also paying a cost here. Can someone please help if in attendance is a way out!!


Answers:    Technically, you will complete a element year residence tax to both NJ and MA. It will be calculated on your actual length of residency within each state. However, if the 2 days you stayed within NJ were not work days, next you should only call for to file surrounded by MA.

Your situation is not uncommon as you can usually document you length of residency contained by each state, so the address within the W-2 should not cause a big problem
Sounds close to you need to stir back to H & R and speak next to a more experienced preparer, supervisor. As first poster said, you file partial year returns for both states, but you're individual paying NJ for two days. The W-2 address is NOT controlling. Block should fix this, probably needs to refile states--file amended returns. Should procure refund from NJ, and enjoy to pay other state.

Don't distribute checks, get Block to fix this first. Checks aren't due until April 15, anyway.

Don't apprehend why any penalty? Unless because nothing withholding for state where you lived, due to your not shifting W-4. That you're stuck with.
Agreed beside the previous posters. I would definitely find another person/company to examine your tariff liability, because it sounds like they're giving you incorrect information.
