Answers:    If you both owe the interest and pay the interest you can reduce by it. Head of house hold, children and marital status don't thing.
Who is paying the majority of the mortgage or are you or your husband court ordered to pay a portion? Say if you split the mtg 50/50 consequently you are each entitled to claim 50% of the interest. It is whomever is paying the mortgage.
