Answers:    According to the IRS:

If you do not receive the missing or corrected form W2 by February 15th from your employer/payer, you may call the IRS at 1-8OO-829-1040 for assistance. You must provide your designation, address (including zip code), phone number, Social Security Number, date of employment, your employer/payer's name, address (including fastener code), and phone number. The IRS will contact the employer/payer for you and request the missing form. IRS will also send you a Form 4852 (PDF), Substitute for Form W-2 or Form 1099-R.

If you do not receive the missing form within sufficient time to file your duty return timely, you may use the Form 4852. If you receive the missing or corrected Form W-2 or Form 1099 after you file your return and a correction is needed, use Form 1040X (PDF), Amended U.S. Individual Income Tax Return. Refer to Topic 308, Amended Returns, for secondary information.
If the employer is not responding, then you have need of to switch gears. Hopefully you kept your pay stubs.

Get IRS Form 4852 and plug within what you think the numbers should be for wages and withholding. Explain surrounded by the space provided that your employer refuses to provide you a W2. Then wallet your return with that notes.

That should cause the IRS to win involved to encourage your employer to comply beside the law. And it will capture you off the hook and allow you to profile.
