Our Sud-Division be started surrounded by 1999, The Declerant go out of business and sold their remaining lots to other builders in 2001. So 100% of the lots be sold 6 years ago. Our covenants that be started contained by 1999 state that a HOA may be formed after 75% of the lots are sold. And can be started beside one and only 10 home owners voting to do so. A date be held a month ago, and it be agreed that we would hang around until tonight to put together a vote.
So tonight we voted and it be 19-7 voting in favor of the HOA, we own 49 lots so 23 be unaccounted for. The creature asking for the HOA pulled several votes out of an envelope and counted those too.
Is here anything that can be done to stop this, Did they lose the right to vote this in since they wait so long to vote for it?
We are surrounded by SC any info. to backing stop this would be great.
