Can a letting agency embezzle and hold a deposit if no contract is signed?
my mum lately signed an application form for a house which she required to rent, this form be for a check to be done on her by a credit agency. My mum also salaried a lb650 deposit for the house at equal time as this, but she did not sign any agreement which said that if she pulled out of house she would lose this lb650 nor did she sign anything to say-so that she apid lb650 (thou this is on her guard statement).
My mum have pulled out of the house due to attitude of the agency, but they are maxim that the lb650 is a deposit and they will be keeping that, but my mum didn't sign the right to be heard that would ensue?
who is surrounded by the right and who is is the wrong?
and where on earth if anywhere can i lug this from here?
Answers:
adjectives landlords enjoy to put deposits into a fund, which they discharge on average lb20 a month (the landlord) - this covers any dispute beside the tenant - if your mum didn't sign a contract and have a bill for the deposit, she is fully entitled to a return.
Additionally if she did sign a contract, and hasn't moved surrounded by - in attendance is usually a cooling rotten time of going on for 14 days where on earth a full repayment can be given.
Get your mum to a solicitors/citizen guidance - and speak to the agencies skipper department.
Don't tolerate them attain away beside it. Gives the rest of us legit landladies/landlords a bleak entitle.

Hi
i am an estate agent.
if your mother give that lb650.00 as a holding deposit later the agency held the property for her to finalise which intended not showing any other prospective tennants the property. if she did that next the agent can hold the holding deposit. because the argument is in that time a prospective tennant could of taken the property.
I no its a bit be a sign of but we enjoy to safeguard ourselves aswell as the proprietor will ask why not a soul have come to see the property within the time your mother give the deposit
This sounds dodgey to me.I am in the process of going through the agency rental application on a property I preference to rent when my house Dutch auction go through.I own occupied contained by a form, rewarded a registration levy of lb90 for the credit check and when that have be done, the hotelier asked if he requests me for a tenant,an agreement will be enter into and a levy of lb40 for the paperwork will be salaried and just consequently will the deposit and first months rent be compensated! Sounds similar to the agency your mother is dealing beside is anyone dishonourable.Go to CAB and bring them to intervene/give suggestion. Good luck.
First you must contact the citizends suggestion (CAB) they will confer you the right warning and you should also expect around contacting a solicitor you may know how to attain legitimate aid, and dont verbs you will be fine.
