My tenant's accountant is witholding my deposit. court or not??

I lived at this property from july '05 to july'07. we switched resident manager within the crash down of '06. the accountant sent out ledgers jan '07 to everyone contained by the building wise saying we be adjectives at the rear on rent. my ledger showed that i didn't wages the first 3 months. which according to my lease the first month be free, and after coincidently the first 2 months be salaried next to money advice which i has-been to preserve the acceptance for. (dumb on my division yes!) necessarily any the accountant or infirm res. mangers be embezzle money and very soon when i give my 30 hours of daylight identify my topical res coordinator said that i would capture deposit rear legs. he also said that he thought they be dropping the support rent issue next to everyone. come to find out after i moved that i won't attain my money backbone because accountant won't do it. so they never tried to evict me or furnish me any other mind and i am simply feed up. do i hold any clout next to this?

Under California regulation, the owner is obligated to return the deposit within full or provide an explanation for any deduction. And, (again California law) the deposit/explanation must be provided in 21 days after you vacate.

You can bring copies of the money information from the company from which you bought them. Ask them for copies of both the front and final sides.

When you enjoy your documentation (or opt that you won't know how to procure it), telephone your landlord/tenant service (many cities extend it as a free service). They will distribute you proposal base on your local imperative.

Next, speak to the innkeeper or representative (accountant or manager), and request your deposit final. Give them a written explanation showing your calculation (even if you don't enjoy the documentation) and a copy of the lease agreement which say that you seize 3 months free.

If that fail to take the desired result, donate them one final accidental by clich¨¦, "I'd prefer to resolve this short going to court, but I will if I hold to..." Be prepared to shift to small claims court.

Keep proceedings of respectively conversation you hold beside them. Note the date, near whom you spoke, and what they said.

In most cases, hotelier cannot withhold the deposit short a accurate purpose. Deposit cannot be used as rent (goes both ways). If their ledger showed you are aft, adjectives you have need of to do is to show your cashed check or receipts. I presumed you have one of those. Worse luggage, rob them to small claim court.
