Real estate agent say I agreed to purchase house "as is". What recourse do I enjoy?
I made an accepted present on a house where I be given 72 hours to have home inspection. I signed a buyer's rights in connection with property condition disclosure which the seller's r.e. agent said is common practice simply letting the seller past its sell-by date the hook from having to explain what they know the property condition to be.
I be present for the inspection but the day after the inspector said if it be him, he would Not buy it. Too many main things needed more immediately than I as a lay soul realized, esp the conditioin of roof. He said it be really a shell. My next step is on Monday for my attorney to convey a list of problems to the seller's attorney. However, yesterday the seller's agent said I signed & agreed to purchase the property "as is" & they will not consider fixing anything or lowering the price I originally offered. In no approach was this my understading, esp. given the inspection. I haven't given deposit even so. Do I have any recourse here? I quality bullied by agent.
Answers: #1 - Stop talking to that Realtor, he/she doesn't work for you, he/she represents the peddler. Not one more word until you enjoy talked to your attorney.
#2 - Take everything you signed to your attorney.
#3 - If you have 72 hours to get a home inspection, I'm hoping you wrote something surrounded by the contract that said you had the opportunity to review the inspection and approve or put a bet on out.
#4 - Do what your attorney says to do.
#5 - Next time, return with your own agent who will represent YOUR interests.
You don't have to buy the house, articulate to your attorney. In this market, the RE agent is trying to selll the house no concern what.
