My discount check be stolen and cashed and the company will not reissue. How do I find out who stole my money?

My previous insurance company owed me a settlement check from February. After over 30 days I call to follow up. They stated that the check be issued on April 24th. I told them contained by May that I have not received the check so they agreed to put a stop costs on it and would reissue the check. I call to follow up surrounded by June, and again in July and they kept recitation me to grant them more time to process the stop reward establish and to reissue the check. Finally, it is very soon August and I've be following up every 30 days. Today they told me that the untested check be cashed and a fresh checked be not reissued. They will not enlighten me where on earth it be cashed or on what date, but I know for sure that it be not me. I judge they should reissue a check since I clearly informed them that I HAD NOT received the check. The customer service supervisor would just argue near me that since I verified my address, that they be not responsible. How do I confrontation this? UHC Direct Bill have be rude and uncooperative.

Answers:
You turn down to your local police department, and folder a pilfering claim. Then THEY contact the insurance company, capture a copy of the cancelled check, and procede beside criminal charges against whoever cashed it.

If it be YOU, and you merely FORGOT, you're looking at check fraud charges, so you'd better be pretty darned sure you didn't purely forget.

Once you hold a police report, the insurance company will enjoy to verbs the cancelled check information ANYWAY - and whoever cashed it, powerfully, their drivers license and/or wall rationalization information will be on the cancelled check.
Small Claims Court they will own to bring in proof that it be your signature on the check. GOOD LUCK
Unfortunately, the company single shows that the check be cashed, they don't own any process to prove that it be or be not you that cashed it. Since the company sent the check to the right address, they are not responsible for any fraud or iffy travels that someone may commit after ward. Don't touch that they HAVE to do anything.

My guidance would be to be VERY nice and give the name the insurance company's billing department and "ask" them to relief you out. If they can notify you what light of day and where on earth the check be cashed you should be capable of track down who stole your money through the dune and sue the pant bad of them and enjoy them sent to detain.

Good luck, I hope you find the contract that stole your money.
The insurance company is reasonably obligated to provide you near a discount inwardly 30 days. If you claim that you did not receive and/or currency the check they issued, they are required to provide you beside proof that the check be cashed, i.e. a copy of the front and rear legs of that check. Once you receive that copy of the check, you can review the signature--if the signature is yours and you simply "forgot" you should apologize for the inconvenience. If the signature is not yours the insurance company will require that you submit an affidavit (they usually will provide you near the specific format or form) and you will own to sign it according to their instructions usually at the forefront of a notary. Once you hold done that they will usually issue a contemporary check to you and it is afterwards the insurance company's condition to pursue the personage that committed the fraud. More than predictable if the amount is substantial satisfactory they will press criminal charges so be remarkably sure of your claim. Also one my client's sisters if truth be told took his check and fraudulently cashed it--my client fixed not to pursue it at that point.

If the insurance company does not want to cooperate and you are sure you did not receive or bread the check, you can profile a complaint near your local insurance commissioner against the insurance company since you are entitled to your money! The insurance company is 100% responsible in jargon of getting the repayment to you and you hold every right to claim against them if you did not brass the check.
does the supervisor own a boss available to natter to - explain your situation-ask for a copy of the cancelled check - if that don't work transmit them your nextl give the name will be to your state insurance commission beside a compalint
Ask the company to convey you a front and backbone check copy.

This will show you the signature on the check and when it cleared the mound.
