Can debt collection agencies palm off deadline on repayment?

Hi,

I've just be contacted by a trace and collection agency, who reckon I owe an electricity bill from 5 years ago! Madness!

Anyway, do they have a legitimate right to impose deadline on repayment on you? For example, can they say 'pay stern lbx over 3 months' if you can't afford it? Can you suggest 6 months? Are they legally competent to deny your request and proceed with litigation conduct if you can't afford what they suggest?

Answers:    Are you in England? There is apparently no decree against them giving strongly worded advice surrounded by letters, such as giving deadline.

But they have little power. Power lies contained by the court. They could say "rate by dd/mm/yy or risk going to court" and many will give somebody a lift this as a threat, though it sometimes is better to go to court.

They can't distribute a bailiff until the case have been within court, and only a court can dispatch a bailiff.
You are already overdue - they don't have to afford the three months if they don't want - they alread gave you 5 years!
