Bankruptcy?

I file for chapter 7 four years ago can I refile? What is the difference between 7 and 13? I'm going to lose my home possibly surrounded by two months. I heared that I can jump to court and hold the settle issue a judgement against me and the creditors cannot collect for 18 years because I hold an beneath age son. Is that true also?

Answers:
you can not folder chapter 7 for 8 years from the date you file next to your federal collapse court.

I would see a ruin advocate because I believe you can wallet for a chapter 13 which will SAVE your house.

As far as the underage son...not collecting for 18 years.to be exact not true. I only know that they can not run your child support and stuff resembling that from you.

I would see a REPUTABLE collapse atty as soon as possible. Chapter 13 can squirrel away your house.you will only own to enter a repayment plan that will ultimate anywhere's from 3 to 5 years.if after 3 years you are eligible to re-file a chapter 7.they can roll a chapter 13 over to a chapter 7 or show deprivation and you won't hold to repay anymore (just mortgage and other secured debts similar to your car). You own to settle up a minimum of 3 years on a chapter 7 repayment plan though.

Really, you requirement to see a ruin attorney.

Well the rule is 7 years beteen bankruptcy. Bankruptcy is handle surrounded by federal court. Chapter 7 is full removal and Chapter13 is a repayment plan next to your creditors. Usually for smaller amount that you owed.
Now as for the piece in the region of the 18 year rule sounds close to a partially truth to a state directive.
For example, a creditor cannot come after anything you earn within child support contained by my state (and most others) so that may be where on earth your getting that information.
They can however get a percentage of any earn income from a opening.
Best article to do is try and work out a gift arrangement beside your creditors.
Sometimes communication is the best win/win situation for adjectives concerned.
Good Luck 2U!
