Can I apply for job loss after man fired irrationally?

I was fired because there be issues such as me telling my boss I hadnt been remunerated for 40 hours(she took it as me arguing with her) and for there man a communication problem and not respecting my boss. I was unaware of within being an issue of disrespecting my boss. She bought lunch for me and a co-worker and I thanked her incredibly much for it but my co-worker did not. My co-worker even told her I had the credit card and receipt when I didnt?! By the road my co-worker ended up lying about me and that be another cause of me being fired. I be a housekeeper and done my job well and never cause any trouble. Done everything I was asked to do. I was given a 2 week servence repay after I was fired and my hubby called me and told me they own paid me another 40 hr check today!(5-08-2008) I havent worked there for a week! I enjoy been out searching for another employment. Please no smart-alec replies as I am kinda stressed with all this. Thanks!

Answers:    Your option depend on several factors.

First of all, it depends on where on earth you worked. If you worked for a large hotel chain, in that are no doubt disciplinary practices in place to resolve the sorts of issues you describe since termination is necessary.

If you worked in a household, that would be another set of standards.

In any armour, your complaint that the employer owed you for another 40 hours seems to have be validated in the paycheck you received today, unless that take-home pay was for the last week you worked. The two-week severance be not of course for actual time worked.

In any case, you sure can file a claim for unemployment. Your employer will be given the opportunity to dispute it. If she does, in that will be a hearing during which you both will be present and state your case to a mediator. You will be given time to dispute anything your employer says.

It is really important, should you opt to pursue a claim, that you stick to only the facts. Don't include information about what you deduce your co-worker may have done and how the employer may have interpreted these things. You can vote "it is my understanding that my employer was soliciting information from my co-worker," but you cannot state near any certainty what was said astern your back nor the thought process of the employer.

State only facts and agree to the referee decide.

You may or may not return with benefits. The good news it costs nil to file; it just take your time. If you get a new employment, this may be a problem for you.

Keep in mind, if you are scheduled for a audible range and you do not attend, you automatically lose the appeal.

Good luck with your job rummage through!
You should apply for unemployment right away. If you were fired for a biddable reason and they can document it, you won't get benefits. However if they didn't enjoy a legitimate reason, even if they fib about it, you can appeal and generally they do a pretty honest job of finding out the truth.

If you were fired for a misconduct and it wasn't documented, you'll probably collect. Apply and see what happen. Many companies won't bother fighting it. The worst that can happen is that you'll be turned down.
I surmise it varies by state and country. I was fired from a employment for "managerial disagreements" and had no trouble collecting laying-off in Washington state in 1999. Being fired for stealing or misuse or other such actions probably would have be different, however. You can only just apply for laying-off and see what happens.

Good luck in your undertaking search.
You can apply, but your ex-employer might appeal. They do not have to reimburse if they can prove you were hired for willful misconduct. However, if they did not keep dutiful records of counseling sessions with you, or disciplinary whereabouts they took against you, they might have trouble proving it. sounds like loosing this opportunity was a blesssing in
disguise - you prob have every right to quit, but
because you didn't you qualify for unemployment!
think it depends on how long you worked in attendance, etc.

go for it & good luck
You can apply. Whether you receive it is not so certain. From what you write, I would say you probably won't acquire unemployment. ABSOLUTELY..why havent you gone in and done so ALLREADY !
